PUBLIC LIABILITY INSURANCE
What is this product about?
This policy covers your legal liability to third party as a result of an accident caused by or through your negligence or negligence of your employees or any defects in the premises owned occurring during the period of cover in connection with your business operations and happening within the territorial limits.
What are the covers / benefits provided?
This policy covers:

All sums which you will become legally liable to pay for compensation in respect of:
- accidental bodily injury or dead to third parties
- accidental loss of or damage to property belonging to third parties
- All costs and expenses incurred with the Insurer’s consent caused in the course of the Insured’s business operations.
What is the subject matter insured?
The insured's legal liability to third parties in respect of accidental bodily injury or dead or property damage to third parties occurring during the period of insurance in connection with the Insured’s business operations as described in the Policy Schedule and situated in the location of risk named in the Schedule of the Policy.
Period of Insurance
Duration of cover is for one year. You need to renew your insurance Policy annually.
How much premium do I have to pay?
The premium you have to pay may vary depending on your business/occupation, limit of liability, the surrounding property, past loss history and our underwriting requirements.
What is the payment mode and how do I pay the premium?
This is an annual policy and you may pay your premium in full either by cash or cheque or bank transfer.
What are some of the key terms and conditions that I should be aware of?
- Duty of Disclosure
- You must give all the facts which you know or ought to know.
- You must ensure that the proposal form is completed accurately as it forms the basis of the insurance contract. - Limit of Indemnity
The Limit of Indemnity that you have to decide based on your liability exposure in relation to your business operations. The Limit of Indemnity can be arranged on:
• limit any one accident; and
• limit any one period. - Claims Notification
If an incident occurs which a claim may arise, you must immediately notify us in writing. You should not admit, offer, promise or pay the third-party claimant without our written consent. - Deductible/Excess
This is the first amount that has to be borne by you before we indemnify you of a loss. - Premium Warranty
Premium must be paid in full and received by us within 30 days from the inception date of the cover, otherwise the cover is automatically cancelled and you will still be responsible to pay the proportion of premium for the period we have been on risk.
What are the major exclusions under this policy?
This policy does not cover:
- Injury to Employees
Bodily injury to any person under a contract of services or apprenticeship with the Insured if such liability is in respect of bodily injury arising out of and in the course of employment of such person by the Insured or to any member of the Insured’s family and any sums payable by the Insured under law and/or legislation relating to occupational bodily injury. - Property in Custody or Control
Property Damage to:
- property owned by or leased or rented to the Insured; or
- property in the physical or legal control of the Insured.
- Insured’s Product
Claims arising directly or indirectly out of any defect or deficiency in goods sold or supplied (which expression included containers) after such goods have passed from the control and actual physical custody of the Insured or of any person in the direct service of the Insured, other than goods sold or supplied at or from a canteen provided by the Insured primarily for the use of Employees of the Insured. - Contractual Liability
Liability assumed by the Insured under any contract or agreement except to the extent that such liability would have been implied by law. - Libel and Slander
Liability arising out of the publication or utterance of a libel or slander. - Pollution
- personal injury or property damage caused by or arising out of the discharge, dispersal, release or escape of Pollutants into or upon land, the atmosphere, or any water course or body of water.
- any costs and expenses incurred in the prevention, removing, nullifying or clean-up of such contamination or pollution
- Faulty Workmanship
The cost of performing completing, correcting or improving any work undertaken by the Insured. - Fines, penalties or liquidated damages, punitive or exemplary and/or aggravated damages and/or any additional damages resulting from the multiplication of compulsory damages.
- War, Civil War and any act of Terrorism
- Radioactive and nuclear energy risks.

What are the pre-acceptance conditions for this product?
- No claims for the past 3 years.
- Insured has never been declined, cancelled or refused coverage previously.
Can I cancel my policy?
You may cancel the policy by giving Us ten (10) working days’ notice in writing. Upon cancellation, you are entitled to a refund of the premium based on the unexpired period of insurance less 10% administration charge provided no claims have been made during the current policy period.
No refund of premium for any cancellation of policy if premium is charged on minimum premium.
