COMPREHENSIVE GENERAL LIABILITY INSURANCE


What is this product about?

This insurance indemnifies you against your legal liability for property damages or bodily injury including death to a third party caused by an occurrence/accident arising from your business.


What are the covers / benefits provided?

This policy covers you against all sums, including costs and expenses, that you shall become legally liable to pay in respect of or arising out of bodily injury to or death of persons, and/or loss of or damage to property occurring during the Period of Insurance and arising out of or in connection with:

  1. General Third-Party Liability

    your Business in the Location of Risk as stated in the Schedule.

  2. Products Liability

    any goods or products (including containers and/or packing and/or instructions and/or advice and/or pamphlets and/or labels and/or any written material) designed, manufactured, constructed, altered, repaired, handled, serviced, treated, sold, supplied or distributed by you or on your behalf in connection with your Business.

The Policy can also be extended to cover Contractual Liability by paying additional premium.


What is the subject matter insured?

Covers against all sums which the Insured is legally liable to pay as damages for property damages or bodily injury (including death) to a third party caused by an Occurrence arising from your business and occurring within the Location of Risk in the Kingdom of Cambodia as shown in the Policy Schedule.


Period of Insurance

Duration of cover is for one year. You need to renew your insurance Policy annually.


How much premium do I have to pay?

The premium you have to pay may vary depending on the nature of your business, limit of liability, extension required, estimated annual turnover, past claim experience and our underwriting requirements.


What is the payment mode and how do I pay the premium?

This is an annual policy and you may pay your premium in full either by cash or cheque or bank transfer.


What are some of the key terms and conditions that I should be aware of?

  • Duty of Disclosure
    - You must give all the facts which you know or ought to know.
    - You must ensure that the proposal form is completed accurately as it forms the basis of the insurance contract.
  • Limit of Liability
    The Limit of Liability that you have to decide based on your liability exposure in relation to your business operations and the insurance requirements imposed by the principal/buyers.
  • Claims Notification
    If an incident occurs which a claim may arise, you must immediately notify us in writing. You should not admit, offer, promise or pay the third-party claimant without our written consent.
  • Deductible/Excess
    This is the amount you have to bear before we indemnify you of a loss.
  • Premium Warranty
    Premium must be paid in full and received by us within 30 days from the inception date of the cover, otherwise the cover is automatically cancelled and you will still be responsible to pay the proportion of premium for the period we have been on risk.

What are the exclusions under this policy?

This policy excludes claim or liability:

  1. By any person arising out of and in the course of his/her employment by the Insured;
  2. For Property damage to property owned by the Insured occupied or rented to the Insured or in the Insured’s care, custody and control;
  3. Caused by the ownership or operation by or on behalf of the Insured of any mechanically propelled vehicle for which insurance is required under the Road Transport Law or equivalent legislation or on any occasion when cover is afforded by a motor policy;
  4. Arising out of the use or operation of Watercraft or Aircraft, by the Insured;
  5. Arising out of liquidated damage clauses, penalty clauses, or performance warranties or liability under a warranty for the fitness or quality of the Insured’s products;
  6. Caused by or arising from any property manufactured, designed, sold, supplied, repaired or installed by the Insured or any structure or contract works including materials for incorporation therein;
  7. For Property damage to underground services unless the Insured prior to commencement of any work has made an enquiry in writing of all underground services and has received where practicable a written response;
  8. For Property damage to sub-surface oil, gas, water or other substance or material or for the cost or expense of reducing to physical possession above the surface of the earth any oil, gas, water or other substance or material;
  9. Arising out of loss of use of tangible property which has not been physically injured or destroyed resulting from (i) a delay or lack of performance of any contract or agreement by the Insured or (ii) the failure of work performed by and/or on behalf of the Insured to meet the level of performance, quality, fitness or durability warranted or represented by the Insured;
  10. For Bodily injury, Property damage or financial loss due to the rendering of or failure to render any professional service;
  11. For Property damage to any well or hole, being drilled by the Insured and/or in the care, custody or control of the Insured, and any cost or expense incurred in redrilling or restoring the well or hole or any substitute well or hole;
  12. For Property damage to any drilling tools, pipes, casing, bit, pump, drilling or well servicing machinery, or any other equipment whilst below the surface of the earth in any well or hole, being drilled by the Insured, and/or in the care, custody or control of the Insured;
  13. For costs or expenses of controlling or bringing under control a well, and/or hole, and/or the expenses incurred in extinguishing fire in or from such wells and/or holes, or holes, or cost of expenses incurred in drilling relief wells;
  14. For costs or expenses incurred in removing wreckage or debris following blow out, cratering, fire, or the loss of control of a well and/or hole being drilled by or on behalf of the Insured, and/or in the care, custody or control of the Insured;
  15. Arising out of pollution or contamination on by seepage, pollution or contamination or caused by disposal or dumping of waste and the cost of removing, nullifying or cleaning-up seepage, polluting or contaminating substances;
  16. Arising out of or in connection with:
    a) any work of demolition except demolition solely undertaken with hand held tools and of structures not exceeding five (5) metres in height by employees in the direct service of the Insured when such work forms an ancillary part of a contract for construction, alteration or repair carried out by the Insured,
    b) the construction alteration or repair of bridges towers steeples chimney shafts blast furnaces viaducts or mines,
    c) pile driving, tunneling or quarrying,
    d) the use of explosives for any purpose,
    e) excavations below three (3) meters in depth,
    f) any work carried out at a height in excess of fifteen (15) meters,
    g) handling and/or stripping out asbestos and/or any other substances or compound that incorporate asbestos, or
    h) Bodily injury or Property damage directly or indirectly caused by Polychlorinated Biphenyl and Silica;
  17. War invasion acts of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power or confiscation or nationalisation or requisition; or ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel;
  18. Wilfully or deliberately caused by the Insured or any employees of the Insured operating in a managerial or supervisory capacity;
  19. Which arise out of onshore refineries petrochemical, oil or chemical plants and any installations;
  20. Arising out of Bodily injury to or illness of any person in the service of the Insured due to occupational and/or industrial diseases and/or cumulative injuries of, any person due to occupational and/or industrial diseases gradually contracted;
  21. For Property damage directly or indirectly resulting from subsidence or weakening of support caused by business or operations of the Insured;
  22. For any loss or liability arising from the following:
    (i) contract frustration, all forms of non-performance of contractual obligations, import and/or export embargo, non-ratification of contracts, exchange transfer, calling of bonds and guarantee and force majeure indemnities,
    (ii) failure or delay to deliver or supply any form of property whatsoever, unless as a direct result of physical damage, or
    (iii) any form of financial guarantee, surety or credit indemnity.

What are the pre-acceptance conditions for this product?

  • The Proposer must have Property insurance placed with us.
  • No claims for the past 3 years.
  • Insured has never been declined, cancelled or refused coverage previously.

Can I cancel my policy?

You may cancel the policy by giving Us ten (10) working days’ notice in writing. Upon cancellation, you are entitled to a refund of the premium based on the unexpired period of insurance less 10% administration charge provided no claims have been made during the current policy period.


No refund of premium for any cancellation of policy if premium is charged on minimum premium.
